Biden’s student debt relief program faces its first legal hurdle. An Indiana-based lawyer filed a lawsuit to stop the president from giving massive handouts to students.
Last month, Biden announced to forgive student loans of up to $20,000 per student, which is expected to put a burden of $500 billion on the American economy.
Student Loan Cancellation Program Faces Legal Challenges
On Tuesday, Frank Garrison, a lawyer from Pacific Legal Foundation, filed a lawsuit against the Department of Education.
Garrison is now seeking for the US District Court for the Southern District of Indiana to impose a temporary restraining order. This would stop the Biden administration from giving the student handouts until the final verdict of the court.

Plaintiffs argued the Biden administration circumvented Congress while obtaining the student loan forgiveness plan, which is a violation of the American Constitution.
Likewise, the lawsuit mentioned the Department of Education is falsely asserting canceling student loans will help in mitigating the effects of the coronavirus pandemic.
Garrison also argued he is himself vulnerable to paying more money to the government in case Biden’s student loan forgiveness program goes into full effect.
Currently, Garrison is seeking to get relief from the Public Service Loan Forgiveness (PSLF) program of Congress, which is specifically designed for people working in either the government or with any non-profit organization.
Under the PSLF program, Garrison was supposed to enjoy debt forgiveness after paying his student loans for ten years.
However, Biden’s student loan program will nullify the benefits of PSLF for Garrison, which would eventually force him to pay more money to the federal government.
As Garrison did not ask for Biden’s student loan forgiveness program and had no way to opt out of it, he is initiating a law battle against the federal government, the Pacific Legal Foundation claimed.

White House Defended Biden’s Socialist Agenda
Another attorney of the Pacific Legal Foundation, Caleb Kruckenberg, stated Congress has not given sweeping authority to the president to unilaterally cancel student loans, which means Biden’s actions go against the Constitution.
As per the American Constitution, only Congress is allowed to pass money-related bills. The executive branch of the government has no legal authority to burden the US economy with a $500 billion program via a simple press release, Kruckenberg added.
Meanwhile, White House press secretary Karine Jean-Pierre defended Biden while commenting on the newly filed lawsuit. Jean-Pierre suggested student handouts are extremely crucial to help working-class Americans who are struggling to pay their debts.
Similarly, Jean-Pierre also insisted people will have an option to opt out of the debt relief program; so it is not mandatory to get the relief under Biden’s program.
White House spokesman Abdullah Hasan also slammed Garrison for his “baseless” lawsuit. Hasan claimed everyone could easily opt out of getting the relief; so the lawsuit is based on false information.
